The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is facing a federal lawsuit filed by the widow of Bryan Malinowski over the agency’s conduct during a March 2024 raid that resulted in his death.
According to the Arkansas Advocate, Maria “Maer” Malinowski filed a federal wrongful-death suit in Little Rock on May 15, 2025, against the ATF and ten agents/task-force officers. The complaint alleges the ATF executed “the most aggressive tactics available” during a pre-dawn raid on March 19, 2024, despite no apparent justification for such a high-risk operation. The suit asserts the raid violated federal and state laws and inflicted needless trauma and loss upon the family.
As reported by AP News, the lawsuit names ten ATF agents, accusing them of failing to adhere to constitutional and departmental requirements such as “knock and announce” before entering—breaching the Fourth Amendment. It states that the agents broke into the Malinowski home about 28 seconds after announcing themselves, forcing a confrontation that turned deadly. The complaint contends the ATF acted recklessly, negligently, and in violation of his rights under the U.S. Constitution.
Local coverage by Little Rock Public Radio noted ATF surveillance traced Malinowski’s activities after undercover agents allegedly purchased firearms from him at gun shows—spurring the raid. The lawsuit disputes whether those transactions triggered the need for a warrant and a high-risk raid, noting Malinowski was a lawful collector who bought 159 firearms from licensed dealers and believed he was operating legally. Arkansas Attorney General Tim Griffin also criticized the ATF’s interpretation of the Firearm Owners’ Protection Act, calling the raid unwarranted—and emphasized the protections of state Castle Doctrine laws.
